The JEP SENIT 8 of 2025 establishes rules on the obligations of the State and the parties appearing in court in matters of reparation, as well as the powers of the SDSJ to evaluate and grade commitment to compliance with the strict conditionality regime (RCE). It consolidates the centrality of harm and the participation of victims in transitional justice and in the non-punitive route.
The Jurisdicción Especial para la Paz - JEP with jurisdiction in the investigation of macrocriminal patterns in the framework or on the occasion of the armed conflict; investigates, judges and punishes those responsible. This instance has a restorative component towards the collective reparation of the victims accredited there as special interveners. To this end, relatives represented in the Norte de Santander subcase, macro case oo3: Murders and forced disappearances presented as combat casualties by State Agents. They present the proposal
alternative and complementary: "Common legacy for a stable future of memory and dignity. Works, works and activities with restorative content - TOAR. Physical and mobile, rural and urban spaces with socioeconomic, humanitarian and memory functions."
